近期,国家移民管理局加大了对“非法入境、非法居留、非法就业”的管理力度,日前指挥部署出入境管理部门打掉了一个组织外籍人员非法骗办来华签证的犯罪团伙,市公安局为维护正常的境外人员劳务用工秩序,确保用工单位和个人合法用工,根据《中华人民共和国出境入境管理法》、《外国人在中国就业管理规定》相关规定,公安机关做出温馨提示:
Recently, National Immigration Administration of China stepped up to the "illegal entry, illegal residence and illegal employment" and deployed the entry and exit administrative departments to cut off an illegal organization for faking the work permit & residence permit for foreigner workers. Public security bureau have made a warm reminder to maintain the normal order of foreign personnel labor employmentand to ensure the project unit and individual legitimate labor,According to the Exit and Entry Administration Law of the People's Republic of China and The Regulations on The Administration of Employment of Foreigners in China. Here are the reminders. 01 禁止个体经济组织和公民个人聘用外国人。 It is prohibited for individual economic organizations and individual citizens to employ foreigners 02 在我市就业的外国人应持职业签证入境(有互免签证协议的, 按协议办理),入境后取得《外国人工作许可证》(以下简称工作证)和外国人居留许可证,方可在中国境内工作。在中国留学、实习及商务拜访的外国人持相关签证,不得在中国工作。 Foreigners who work in Our city shall enter China with work visas (if there is an agreement on mutual visa exemption, it shall be handled according to the agreement), and may work in China only after obtaining the Foreigner's Work Permit and the Foreigner's Residence Permit. Foreigners who study in China, have internship in China or business visits are not allowed to work in China if they hold relevant visas only. 03 用人单位聘用外国人,须提供拟聘用外国人的简历;该外国人从事该项工作的资格证明;拟聘用的外国人健康状况证明等文件。 If an employer intends to employ a foreigner, it shall provide proof of his/her work experience,education certificate; medical examination and other documents, and contract according to law. 04 若外国人离开发证机关规定的区域工作或在原规定的区域内变更用人单位且从事不同职业的,须重新办理工作许可手续。 If a foreigner changes his employer within the area specified by the license-issuing authority but still engages in the same type of occupation, he shall go through the procedure for changing the work permit with the approval of the license-issuing authority. 05 外国人在中国工作的用人单位必须与其工作证所注明的单位相一致。 foreigner working in the enterprise in China must be the same as the one indicated on his/her work permit. 06 外国人在发证机关规定的区域内变更用人单位但仍从事原职业的,须经原发证机关批准,须办理工作证变更手续。 Foreigners leave the location designated by the license-issuing authority to work or change their employers and engage in different type of occupationsshall go through the procedure for new work permits again. 07 外国人在中国就业期间遗失或损坏其工作证的,应立即到原发证机关办理挂失、补办或换证手续。 Foreigners who lose or damage their work permit during their employment in China shall go through the procedures of reporting the loss, reissuing or changing at the original certificate-issuing authorities immediately 08 对私自雇用外国人的单位和个人,在终止其雇用行为的同时,可以处5000元以上、50000元以下的罚款,并责令其承担遣送私自雇用的外国人的全部费用。 Companies and individuals that employ foreigners without authorization shall terminate their employment and will, at the same time, be imposed a fine of not less than 5,000 yuan but not more than 50,000 yuan, and be ordered to bear all the expenses for repatriating foreigners who have been employed without authorization. 09 对未经中华人民共和国劳动部或者其授权的部门批准私自谋职的外国人,在终止其任职或者就业的同时,可以处1000元以下的罚款;情节严重的,并处限期出境。 Foreigners who work in China without legalized work permit will be fined not more than RMB 1,000 yuan. If it’s serious enough, they shall also be ordered to leave the country. 10 容留、藏匿非法入境、非法居留的外国人,协助非法入境、非法居留的外国人逃避检查,或者为非法居留的外国人违法提供出境入境证件的,处二千元以上一万元以下罚款节严重的处五日以上十五日以下拘留,并处五千元以上二万元以下罚款,有违法所得的,没收违法所得。 The ones Sheltering, hiding or assisting foreigners without work permit and residence permit, or offer foreigner illegalized certificate, will be issued a fine of not less than two thousand yuan but not more than ten thousand yuan. What requirements do foreigners have to meet to apply for a work permit in China? 1. 年满18周岁,身体健康;At least 18 yrs old and in a good health 2. 具有从事其工作所必须的专业技能和相应的工作经历; With related professional skills and relevant work experience 3. 无犯罪记录;None crime record 4. 在国内有确定的用人单位,或自己创立公司; with offer from employing company or setting up and operate a company personally 5. 持有有效护照及工作签证;with valid passport and work visa 企业如何合法的雇佣外籍员工呢?
